By accessing and using the fLaiv.ai website and services (collectively, the "Services"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

You must be at least 18 years old and capable of entering into a binding contract to use our Services. By registering an account, you represent and warrant that all information you provide is accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to use our Services only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the Services. Prohibited behavior includes: • Harassing or causing distress or inconvenience to any person • Transmitting obscene or offensive content • Disrupting the normal flow of dialogue within our Services • Attempting to gain unauthorized access to our systems • Using our Services for commercial purposes without authorization

You retain all rights to any content you submit, post, or display on or through the Services. By submitting content, you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and distribute such content. You represent and warrant that you own or have the necessary rights to the content you submit. All intellectual property rights in the Services and their content (excluding user-submitted content) are owned by fLaiv.ai or our licensors.

While we strive to provide accurate information, fLaiv.ai makes no representations or warranties regarding the accuracy, completeness, or reliability of the Services. The AI-generated formulations are provided for informational purposes and should be validated by qualified professionals before implementation. We do not guarantee that: • The Services will be uninterrupted or error-free • Any defects will be corrected • The Services are free from viruses or harmful components

If you purchase a paid subscription: • You agree to pay all charges at the rates in effect when the charges are incurred • Billing cycles are monthly unless otherwise stated • Subscriptions automatically renew unless cancelled before the renewal date • Refunds are generally not available, except as required by law • We may change pricing with 30 days' notice

We reserve the right to terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including if you breach the Terms of Service. Upon termination, your right to use the Services will immediately cease. We may also delete your account data in accordance with our data retention policies.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. fLaiv.AI MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICES. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL fLaiv.AI, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify and hold harmless fLaiv.ai and its officers, directors, employees, and agents from any claim, demand, loss, liability, or expense (including attorney's fees) arising out of or relating to: • Your use of the Services • Your violation of these Terms • Your violation of any applicable law or regulation • Your infringement of any third-party rights

These Terms shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

• Entire Agreement: These Terms constitute the entire agreement between you and fLaiv.ai regarding the Services. • Severability: If any provision is found to be unenforceable, the remaining provisions shall continue in full force and effect. • Waiver: Our failure to enforce any right does not constitute a waiver of that right. • Assignment: You may not assign these Terms without our prior written consent.

For users in the European Union: You have additional rights under EU law, including the right to withdraw from contracts within 14 days. For users in California: You have rights under California law, including consumer protection rights. For users in other jurisdictions: Your use of the Services is subject to applicable local laws and regulations.
